MEMBERSHIP AGREEMENT

1. Parties
   a) This Explode Denim Membership Agreement ("Agreement") has been concluded on {date} between EXPLODE DENIM, located at ATİLAS TEKSTİL SANAYİ ve DIŞ TİC. LTD. ŞTİ., the owner of the www.explodedenim.com website, and the internet user who becomes a member of the www.explodedenim.com website ("MEMBER").

2. Subject of the Agreement

The subject of this Agreement is to determine the terms and conditions of the MEMBER's use of and benefit from the www.explodedenim.com website owned by Explode Denim.

3. Rights and Obligations of the Parties
   3.1. The MEMBER agrees and undertakes to comply with all legal regulations while using the www.explodedenim.com website and not to violate these provisions. Otherwise, all legal and criminal liabilities arising will be the sole responsibility of the MEMBER.
   3.2. The MEMBER cannot engage in activities and transactions on the www.explodedenim.com website that prevent or hinder the use of others' services (spam, virus, trojan, etc.).
   3.3. The MEMBER cannot use the www.explodedenim.com website for any purpose that disrupts public order, is against general morality, is disturbing and harassing to others, infringes on the intellectual and copyright rights of others, and is unlawful.
   3.4. The opinions and expressions stated by the members on www.explodedenim.com, and the expressions used are solely the personal opinions and comments of the members, and the MEMBER is solely responsible for the consequences of these opinions and comments. These opinions and thoughts have no connection with EXPLODE DENIM. EXPLODE DENIM has no responsibility for any damages that may be incurred by third parties or institutions due to the opinions and views declared by the MEMBER or for any damages that the MEMBER may incur due to the opinions and views declared by third parties or institutions.
   3.5. The MEMBER declares and undertakes that the personal and other miscellaneous information given when registering on www.explodedenim.com is accurate and that they will compensate in cash for all damages that EXPLODE DENIM will incur due to the inaccuracy of this information.
   3.6. The right to use the password obtained by the MEMBER from EXPLODE DENIM's website belongs solely to the MEMBER. The MEMBER cannot give this password to any third party. The legal and criminal responsibility for the use of the password belongs entirely to the MEMBER.
   3.7. EXPLODE DENIM will not be held responsible for the unauthorized acquisition of MEMBER data by unauthorized persons and for any damages to MEMBER software and data. The MEMBER, by using the www.explodedenim.com website, agrees not to claim any compensation from EXPLODE DENIM for any damage they may suffer due to the use of the site.
   3.8. The MEMBER agrees not to access unauthorized information and software of other internet users and not to use them. Otherwise, all legal and criminal liability arising from this will be entirely the responsibility of the MEMBER.
   3.9. The MEMBER, who violates one or more of the articles listed in this Agreement, agrees to be solely responsible for all damages that may arise and to indemnify and hold EXPLODE DENIM harmless from any damages, lawsuits, claims, and allegations that may arise for this reason.
   3.10. EXPLODE DENIM has the right to suspend or terminate the MEMBERSHIP unilaterally at any time without undertaking any responsibility, and to delete all data, documents, and files belonging to the MEMBER.
   3.11. The intellectual property rights of EXPLODE DENIM's website design and software, as well as textual and visual content related to products, are owned by EXPLODE DENIM, and they cannot be used by the MEMBER without the express permission of EXPLODE DENIM.
   3.12. Within the framework of legal regulations or for the improvement and development of the www.explodedenim.com website, EXPLODE DENIM may collect certain information, such as the name and IP address of the Internet service provider used to access the site, the date and time of access to the site, the pages accessed while on the site, and the Internet address of the website that enables direct connection to the site.
   3.13. EXPLODE DENIM has the right to communicate with the MEMBER through letters, emails, SMS, phone calls, and other means for communication, marketing, advertising, promotion, notification, and other purposes regarding the promotion of EXPLODE DENIM and ATİLAS TEKSTİL SANAYİ ve DIŞ TİC. LTD. ŞTİ. brands. By accepting this Agreement, the MEMBER will be deemed to have consented to the sending of informative emails to their email address and informative SMS to their mobile phone. If the MEMBER wishes to opt-out of receiving emails and/or SMS, they can request the cancellation of email and/or SMS transmission by contacting EXPLODE DENIM Customer Service. Clause 3.13. provisions are reserved

   3.14. The MEMBER declares and accepts that within the scope of current and/or future applications, EXPLODE DENIM and ATİLAS TEKSTİL SANAYİ ve DIŞ TİC. LTD. ŞTİ. are permitted to send information and announcements regarding the promotion of products and services, advertisements, campaigns, advantages, surveys, and other customer satisfaction practices. The MEMBER declares and accepts that when becoming a member of EXPLODE DENIM and/or in other ways in the past or in the future, personal and shopping information and consumer behavior information may be collected, used, and archived by EXPLODE DENIM for the above-mentioned purposes. The MEMBER, unless otherwise stated, declares and accepts that even when their membership ends, they permit the collection, use, and archiving of data by EXPLODE DENIM. The MEMBER agrees not to make any claims for direct and/or indirect material and/or moral, negative and/or positive, in short, any damages suffered due to the collection, sharing, use, archiving, and access to the above-mentioned information and not to hold EXPLODE DENIM responsible. If the MEMBER wishes to change their data sharing preferences, they can submit this request to EXPLODE DENIM's customer service.
   3.15. EXPLODE DENIM may disclose the MEMBER's personal information (a) when required by existing laws or regulations, or by a court decision or administrative order, and (b) in the cases specified in Article 3.13., and (c) with the consent of the MEMBER.
   3.16. Measures have been taken within the available facilities to ensure that the EXPLODE DENIM website is free of viruses and similar malicious software. In addition, for ultimate security, it is the responsibility of the user to provide their virus protection system and ensure necessary protection. In this context, by entering the EXPLODE DENIM website, the MEMBER is deemed to have accepted that they are responsible for any errors that may occur in their software and operating systems and their direct or indirect consequences.
   3.17. EXPLODE DENIM has the right to change the content, design, and software of the site at any time, change or terminate any service provided to users, and delete user information and data registered on the website whenever desired.
   3.18. EXPLODE DENIM may update, modify, or terminate the terms of this Agreement at any time without the need for prior notice or warning. Any updated, modified, or terminated provision will be effective for all MEMBERS on the publication date.
   3.19. Under this Agreement, EXPLODE DENIM has the authority to send informative emails to the electronic mail addresses registered with the MEMBERS and informative SMS to their mobile phones. By approving this Agreement, the MEMBER will be deemed to have consented to the sending of informative emails to their email address and informative SMS to their mobile phone. If the MEMBER wishes to opt-out of receiving emails and/or SMS, they can request the cancellation of email and/or SMS transmission by contacting EXPLODE DENIM Customer Service. Clause 3.13. provisions are reserved.

4. Termination of the Agreement Either party may terminate this Agreement at any time by notifying the other party with a unilateral notice.
5. Resolution of Disputes This agreement will remain in effect until the MEMBER cancels their membership or until their membership is canceled by EXPLODE DENIM. In the event of a violation of any provision of the membership agreement by the MEMBER, EXPLODE DENIM may unilaterally terminate the agreement by canceling the MEMBER's membership.
6. Resolution of Disputes Istanbul Central Courts and Execution Offices are authorized to resolve all disputes arising from or related to this Agreement or arising from this Agreement.
7. Effectiveness The registration of the MEMBER's membership is realized when the MEMBER reads and accepts all the articles in this Agreement. This Agreement has been concluded and entered into force at the moment the MEMBER becomes a MEMBER.
